Grit is an independent brokerage headquartered in Salt Lake City. Utah is our home market, and we place commercial insurance and surety bonds for Utah businesses every day.

Is Workers Comp Required in Utah?

Yes, for almost every employer. The Utah Insurance Department puts it plainly: with few exceptions, Utah employers are required to maintain workers compensation insurance. Once you hire employees, you need a policy from an insurance carrier or authorization from the Labor Commission to self-insure.

Self-insurance is built for large employers with the financial strength to pay claims directly. For nearly every small and mid-sized Utah business, coverage means buying a policy.

If you are a licensed contractor, DOPL also requires proof of workers comp, with DOPL named as certificate holder, or a waiver. More on that on our Utah contractor insurance page.

Who Can Skip It: Utah Waivers and Exclusions

Utah lets certain owners with no employees opt out through a Workers' Compensation Coverage Waiver (WCCW) issued by the Labor Commission. Categories that may qualify:

  • Sole proprietors with no employees other than the owner.
  • Partnerships with no employees other than the partners.
  • LLC members, treated like partners for this purpose.
  • Directors and officers of a corporation.
  • Independent contractors in any of those categories, with no employees.

Separately, a corporation that does not contract out its work and has no employees except directors or officers can file a corporate exclusion, limited to five directors or officers.

Three things to know before you rely on one:

  • A waiver covers the owner, not a crew. The day you hire an employee, you need a policy.
  • The Labor Commission can investigate whether a waiver is valid. A waiver on file does not settle the question if the business actually has employees.
  • General contractors may still want a policy. Many will not let a waived sub on site, or they will charge the sub's labor to their own policy at audit. Ask before you bid.

Whether a particular worker is an employee or an independent contractor is a legal question, and the answer carries real consequences. Talk to an employment attorney about classification. We can tell you how the policy and the audit will treat them.

What Happens If You Do Not Carry It

The Labor Commission's Compliance Section monitors employers across the state for coverage and assesses penalties against those without it. Penalties are the smaller problem. An uninsured employer is still responsible for an injured employee's medical bills and wage replacement, out of pocket, and a serious injury can run well into six figures.

Utah law also makes it unlawful to interfere with an employee's workers comp claim, with fines up to $5,000. Report injuries to your carrier promptly and let the claim run its course.

WCF, Private Carriers, and How to Compare

Utah is not a monopolistic state. You are not required to buy from a state fund. The Utah Insurance Department notes that workers comp is available from a large number of companies.

WCF Insurance is the name most Utah employers know. It started as the state's workers compensation fund, it writes a wide range of Utah classes, and it is where many hard-to-place risks end up. Private carriers compete for the classes they like, and for those classes their pricing and service can be better.

The practical point: you only see the real market if someone quotes both. An independent agent can put your application in front of WCF and private carriers in the same pass.

How Utah Workers Comp Premium Is Calculated

The math is the same for every employer. What changes is the inputs:

InputWhat it isWhat you control
Class codeThe code that describes the work each employee does. Rates differ sharply between an office clerk and a roofer.Make sure every employee is in the correct class. Clerical staff misclassified into a field code is common and expensive.
PayrollPremium is charged per $100 of payroll in each class.Estimate honestly. The audit trues it up either way.
Experience modA factor comparing your claims to similar businesses. Below 1.00 lowers premium, above 1.00 raises it.Safety programs, return-to-work, and reporting claims promptly.
Credits and debitsCarrier adjustments for your operation and loss control.Show the carrier your safety program and training records.

The audit. At the end of the policy year the carrier audits your actual payroll. If you paid uninsured subcontractors, most carriers will add their payroll to yours and charge premium on it. Collect a current certificate from every sub, every job.

Out-of-State Work and Employer's Liability

Utah crews regularly cross into Idaho, Nevada, Arizona, Colorado and Wyoming. A Utah policy does not automatically cover work in another state. Coverage depends on how the policy is written, and the Labor Commission issues extra-territorial certificates for Utah employees working outside Utah.

Wyoming is the one that catches Utah contractors. It is a monopolistic state, so workers comp there comes from the state fund, not a private carrier, and your Utah policy's employer's liability will not follow you in. That gap is closed with stop gap coverage. Tell us every state your crews work in before the policy binds.

Employer's liability is Part Two of the workers comp policy. It covers lawsuits that fall outside the no-fault system, such as a claim from an employee's family. Many contracts and umbrella carriers require limits above the standard, so check the limits on your policy against your contracts.

Frequently Asked Questions

Is workers comp required in Utah?

Yes, for almost every Utah employer. Once a business has employees, Utah law requires workers compensation coverage, through an insurance carrier or approved self-insurance. A few categories are exempt, and owners with no employees can apply for a waiver.

Who is exempt from workers comp in Utah?

Sole proprietors, partners and LLC members with no employees, corporate officers and directors, and independent contractors with no employees may qualify for a Workers' Compensation Coverage Waiver from the Utah Labor Commission. Corporations with no employees other than up to five directors or officers can file a corporate exclusion.

What happens if a Utah business does not carry workers comp?

The Utah Labor Commission's Compliance Section monitors employers for coverage and assesses penalties against businesses without it. The business also stays responsible for an injured employee's benefits, which can cost far more than a policy would have.

Do I have to buy workers comp from WCF in Utah?

No. Utah is not a monopolistic state. WCF Insurance is one option, and many private carriers also write workers comp in Utah. An independent agent can quote both.

Does Utah workers comp cover employees working in other states?

It can, but not automatically. Coverage for work in other states depends on how the policy is written, and some states, including Wyoming, require coverage from their own state fund. Tell your agent every state where your crews work before the policy binds.
